New Contract Award

We are very pleased to announce that we have been successful in tendering for a new legal aid contract in criminal law which will see the firm able to undertake own client & duty solicitor work in the Teesside area  and own client work in Tyne & Wear and from our base in Yorkshire. Refugee Council Football Tournament, Yorkshire

Well done to Team Bananarama for their victory at the Refugee Council's Football Tournament last week! Africa United put up a strong opposition in the final but were beaten 2-0. An enjoyable day was had by all! We look forward to next year and this becoming an annual event!

Legal Aid for Family Law

Your right to family Legal Aid changed significantly on the 1st April 2013. On 1st April 2013 legal aid was abolished for divorce, finance and children matters unless you can demonstrate that you are a victim of domestic violence, there are issues of child protection in relation to your children or you are under 18 years of age.


If as a result of the changes you are not eligible for Legal Aid we can, in most cases, work on a fixed fee basis. Our rates are very competitive. Please see “our family law charges” page for further details.


Legal Aid does however remain available for:


Public family law proceedings regarding the protection of your children (care proceedings)

Private family law proceedings with evidence of child abuse

Child Abduction

Representation of children in private family cases

Legal advice in support of mediation

Domestic Violence injunction cases

Forced Marriage protection orders

Changes to cases that can be publicly funded from 1st April 2013

Your right to legal aid changes significantly on 1 April 2013

The 8 categories are OUT OF SCOPE from 1 April 2013. This means you will be unable to get Legal Aid for the following applications:

· Immigration Applications

· Family Reunion

· Art 8 (family and private life) ECHR applications for leave to enter or remain

· Post conviction deportation

· EU applications for confirmation of a right to reside

· Applicants with mental health/capacity issues applying for Leave To Enter or Leave To Remain (other than Art 3 ECHR grounds)

· Entry clearance applications or appeals (unless Art 3 ECHR)

· Appeals for excluded cases to Tribunals and higher courts (Court of Appeal and Supreme Court)

What is in scope after 1 April 2013? These are applications that you still may be able to be legally aided for subject to means and merits.

· Asylum: Rights to enter the UK arising from Refugee Convention and Art 2 (Right to Life) or ART 3 ECHR. This does not include Article 8. Includes applications for settlement/further permission to remain as a refugee or with HP or DL if you were granted your leave under Article 3. SET (Protection) if there is a continued risk on return arising for a Refugee Convention reason and /and Art 2 (right to life) or ART 3 to justify ILR. If your grant of DL is limited leave granted for 30 months then it is OUT OF SCOPE and you will not be legally aided.

· Detention under immigration powers this includes bail, temporary release or admission including the conditions applied to the person on release but NOT immigration applications.

· Applications for leave to remain under the domestic violence rule, not every victim of DV is covered

· Application for leave by Victims of Trafficking, not every VOT is covered

· Terrorism Prevention and Investigation Measures

Higher Rights of Audience

We are very pleased to announce that one of our Partners Mrs Lynne Brakaj has passed her Higher Rights Exam (Civil). As well as being accredited to the highest level (level 3) Lynne is now able to act as Advocate in the higher courts ( High Court, Court of Appeal & Supreme Court). Along with the recent creation of our dedicated High Court team covering our entire Practice, this means that we are one of the very few firms in the North of England where specialist immigration advice and advocacy can be provided at all levels.

Students & other PBS Applications

Following the recent announcement made by UKBA available at this link:

It is important for students and others making PBS applications to make sure they submit all of their original supporting evidence with their application.  The UKBA is applying this change very strictly as of Monday 23.05.2011 – it will remain to be seen if the Tribunals interpret it as strictly.

Any cases which have been adjourned or part–heard before the change will, as of today, be subject to this amendment.

In the past if a PBS application was refused because of a failure to submit a document this could be rectified at court – as long as the document relied upon was available at the time of the application.

This won’t be admitted as evidence as of today on the basis of the UKBAs change. ILPA has written a letter of complaint and this is awaiting  a response, so for the moment we will just have to wait and see.  

The Statement of Intent on the UKBA website also makes for some interesting reading. One of the most startling changes will be that only post-graduates studying for 12 months or more in the UK and government sponsored undergraduate students will be able to bring their dependents (spouse & minor children) into the UK. This does not affect those with Tier 4 visas now; they can still have their dependents and still bring their dependents into the UK at the moment...

Exciting Developments in the Middle East

We are delighted to announce a further development in our commitment to the Middle East and our client’s there. Our Middle Eastern business partners are in the process of finalising details of the imminent launch of a new company in the region providing travel and visa services across the Middle East. The new company is to be launched by our Middle Eastern business partners, “Strategic Business Implementation”. The company has exciting plans to open an office in Jordan first, followed by offices in Iraq and elsewhere in the region.


As a leading UK based Immigration Law Firm we are delighted to build on our strong links with the Middle East by providing Immigration Law advice as part of this joint venture.
