Family Reunion

 

 

Refugees and those granted Humanitarian Protection are entitled to bring pre-existing spouses and children (under 18) to the UK following a grant of status.  

 

There are no requirements in relation to maintenance and accommodation. 

 

However, it will be necessary to demonstrate that the family members were pre-existing family members.   

 

It is occasionally possible to bring additional family members to the UK where there are compelling compassionate reasons.  Such cases will depend upon the particular circumstances of the case and will generally require the case being considered by an Immigration Judge. 

 

In the past, it has been impossible for Refugees to bring spouses etc to the UK where the family was began after leaving the country of persecution as the Sponsor was not settled in the UK. 

 

However, the Tribunal has recently held that as long as the other requirements for a spouse/child visa are met.
